General terms and conditions of business


§ 1 Contracting parties, scope of application

  1. Contracts are concluded in the name and for the account of tolingo GmbH (Hamburg Local Court, HRB 102250, VAT ID: DE 814889279), represented by the Managing Director Jens Völkel, Kühnehöfe 3, 22761 Hamburg.
  2. The following General Terms and Conditions in the version valid at the time of the order shall apply exclusively to the business relationship between tolingo GmbH (hereinafter referred to as “Sworn Translators”) and the customer (hereinafter referred to as “Customer”).

§ 2 Conclusion of contract

  1. The customer can choose from the range of Sworn Translators allows the customer to select from a wide range of document types (certificates, certificates, contracts, etc.) and, after uploading the desired document for certification and selecting the desired language combination consisting of "source language" and "target language," to collect these in a so-called shopping cart by clicking on the "Add to cart" button. For some source languages ​​(e.g. Ukrainian, Serbian), the customer will Sworn Translators requests that all names contained in the document be provided in Latin spelling before completing the order. Subsequent changes are excluded and do not constitute grounds for complaint. By clicking the "Order with payment" button, the customer submits a binding request for certification of the documents collected in the shopping cart. Before submitting the order, the customer can edit and view the data at any time. However, the request can only be submitted and transmitted if the customer accepts these contractual terms and conditions by clicking the "Accept Terms and Conditions" button, thereby incorporating them into their application.
  2. Sworn Translators will then send the customer an automatic confirmation of receipt via email, which will list the customer's order again. The automatic confirmation of receipt merely documents that the customer's order has been received by Sworn Translators and does not constitute acceptance of the application. The contract is only concluded upon the submission of a declaration of acceptance by Sworn Translators, which will be sent with a separate email (order confirmation). In this email or in a separate email, but no later than upon delivery of the certification, the contract text (consisting of the order, general terms and conditions and order confirmation) will be sent to the customer by Sworn Translators will send the contract confirmation on a permanent storage medium (email or paper printout). The contract text will be stored in compliance with data protection regulations.
  3. The contract is concluded in German.

§ 3 Delivery, delivery time, availability

  1. From Delivery times specified by Sworn Translators are calculated from the date of order confirmation, subject to prior payment of the certification fee. If no or no different delivery time is specified for the respective certification, the delivery time for email as a PDF document is 3-4 working days. (Mon.-Fri.) and for shipping by mail, 5-6 business days (Mon.-Fri.). Customers can also choose faster delivery of the digital copy in the form of 24-hour express delivery.
  2. If at the time of the customer’s order, certification of the document selected by him is temporarily not possible, Sworn Translators will inform the customer of this immediately in the order confirmation. If certification is not possible on a permanent basis, Sworn Translators refrains from accepting the offer. In this case, no contract is concluded.
  3. If the document provided by the customer contains criminal or illegal content, Sworn Translators may reject the certification and refrain from issuing a declaration of acceptance. In this case, no contract will be concluded.
  4. Sworn Translators only delivers to customers whose billing and delivery addresses are located in Germany.
  5. The Express shipping method is available for the following products: birth certificates, marriage certificates, death certificates, and driver's licenses. This shipping method is available for the following language combinations: EN/DE, DE/EN, ES/DE, DE/ES, IT/DE, and DE/IT.
  6. The 24-hour express shipping only applies to the digital version of the product.
  7. The express option is available for a maximum of four pages of the products listed above. The delivery time for the original document remains unchanged (5-6 business days Mon-Fri by mail).
  8. If there is a product without the express option in the shopping cart in addition to one of the products with the express option, this shipping method cannot be selected.
  9. Express delivery takes place within 24 hours on working days (Mon.-Fri.) . Orders placed on weekends/public holidays will be processed by the end of the following business day.

§ 4 Retention of title

Until full payment, the delivered certifications remain the property of Sworn Translators.

§ 5 Prices and shipping costs

  1. All prices shown on the website of Sworn Translators' prices include the applicable statutory sales tax.
  2. Shipping at Sworn Translators is generally free of charge. There's also the option to choose express digital delivery within 24 hours for certain product variations.
  3. The goods will be shipped by post. The shipping risk is borne by Sworn Translators.

§ 6 Terms of payment

  1. The customer can pay by credit card (American Express, Visa, Mastercard), PayPal, Apple Pay, Google Pay or by invoice in cooperation with Klarna.
  2. Payment by invoice is made in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm. In this case, Sworn Translators assigns the claim to Klarna Bank AB (publ). Payment by invoice requires a positive credit check of the customer. The payment deadline is 30 days from the date the certification is made available.   3. Payment of the price for the certification is due immediately upon conclusion of the contract.

§ 7 Warranty

Sworn Translators is liable for defects in accordance with the applicable statutory provisions, in particular Sections 634 et seq. of the German Civil Code (BGB).

§ 8 Liability

  1. Claims by the customer for damages are excluded. Excluded from this are claims for damages by the customer resulting from injury to life, body, health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages resulting from an intentional or grossly negligent breach of duty by Sworn Translators, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
  2. In case of breach of essential contractual obligations, Sworn Translators is only liable for damages that are typical for the contract and foreseeable if they were caused by simple negligence, unless the customer has claims for damages resulting from injury to life, body or health.
  3. The restrictions of paragraphs 1 and 2 also apply to the legal representatives and vicarious agents of Sworn Translators if claims are made directly against them.
  4. The limitations of liability resulting from paragraphs 1 and 2 shall not apply if Sworn Translators has fraudulently concealed the defect or has provided a guarantee for the quality of the item. The same applies if Sworn Translators and the customer have reached an agreement regarding the quality of the item. The provisions of the Product Liability Act remain unaffected.

§ 9 Cancellation policy

1. Consumers generally have a statutory right of withdrawal when concluding a distance selling contract, which Sworn Translators will inform you below in accordance with the statutory model. A sample cancellation form can be found in paragraph 2.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform us, tolingo GmbH, Kühnehöfe 3, 22761 Hamburg, Tel: +49 40 413 583 024, Email: hello@sworntranslators.de, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

§ 10 Final provisions

  1. Contracts between The contract between Sworn Translators and the customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, particularly those of the country in which the customer, as a consumer, has his or her habitual residence, remain unaffected.
  2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and Sworn Translators Hamburg.
  3. Even if individual provisions are legally invalid, the remaining parts of the contract remain binding. The invalid provisions, where applicable, shall be replaced by the statutory provisions. However, if this would represent an unreasonable hardship for one of the contracting parties, the contract shall be invalid in its entirety.

§ 11 Online Dispute Resolution (OS)

  1. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
  2. The EU Commission has created an internet platform for online dispute resolution (the "ODR platform"). The ODR platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Customers can access the ODR platform at the following link: ec.europa.eu/consumes/odr/.
